Terms & Conditions 

Welcome to the Krystal Gemological Laboratory website (“Site”). These Terms & Conditions (“T&C”, “Terms”) govern your access to and use of this Site and any services provided by Krystal Gemological Laboratory (“KGL”, “we”, “us”, “our”). By using the Site or our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Definitions

  • “Client”, “you”, “your”: any person or entity accessing the Site or engaging KGL’s services.
  • “Services”: gemological testing, diamond grading, gemstone identification, jewellery testing, reports, educational courses, and related services offered by KGL.
  • “Report”: any certificate, grading sheet, identification document or statement of analysis issued by KGL.
  • “Site”: the website located at https://kgalabs.in/ and any sub-domains, associated pages, or other online presence.

2. Use of the Site

  • The Site is provided for information only. We reserve the right to modify, suspend or discontinue the Site (or any part) at any time without liability.
  • You agree to use the Site only for lawful purposes and in a manner consistent with all applicable laws and regulations.
  • You agree not to use the Site in any way that could impair, damage or interfere with our systems or the Site’s accessibility.

3. Services & Reports

  • KGL provides gemological and jewellery testing services based on specified scopes.
  • Reports issued by KGL constitute professional assessment based on the information and items submitted by the Client.
  • The scope of services, turnaround time, fees, sample handling, mounting/un-mounting (if applicable) will be as per KGL’s service policy and as agreed with the Client.
  • Reports are based on the state of the item at the time of inspection. Unless otherwise stated, the item is not guaranteed against subsequent changes, damage, wear, treatment, or alteration after the date of the Report.
  • Clients should ensure proper care, handling and insurance of the items after dispatch or receipt.

4. Fees, Payment & Deliverables

  • Service fees are as quoted by KGL and subject to change. Payment terms will be communicated at the time of service engagement.
  • The item(s) submitted remain the property of the Client unless otherwise agreed. KGL may retain images, data or records of the assessment for internal archival purposes.
  • KGL will issue the deliverable (Report) upon payment and completion of the service, subject to any agreed terms.
  • KGL is not liable for delays caused by factors outside its control (shipment delays, customs, client delays, etc.).

5. Client Obligations

  • You confirm that the item(s) submitted are legal, owned by you (or you have authority to submit) and are submitted with full disclosure of relevant information (e.g., previous treatments, mounting, known issues).
  • You will cooperate with KGL’s requests for information or clarification. Failure to do so may result in delay, additional charges or cancellation of the service.
  • You accept responsibility for packing, shipping (if applicable), insurance and safe handling of items submitted. KGL will apply due care in handling but is not liable for loss, damage or deterioration during transit unless it arises from KGL’s gross negligence.

6. Intellectual Property

  • All content on the Site (text, graphics, logos, icons, images, software) is owned or licensed by KGL or its affiliates and protected by applicable laws.
  • You may view, download or print content for your personal, non-commercial use only. Any other use (reproduction, modification, distribution) requires KGL’s prior written consent.
  • The Report issued remains the property of KGL; the Client obtains a license to use it for its intended purpose (e.g., certification, insurance, trading) but may not reproduce it for other items.

7. Limitation of Liability

  • To the fullest extent permitted by law, KGL’s total liability arising out of or in connection with services, Reports or the Site shall not exceed the amount of the fee paid by the Client for the particular service that gave rise to the claim.
  • KGL is not liable for any indirect, incidental, special or consequential damages (including loss of profits, business interruption, loss of data) even if KGL has been advised of the possibility of such damages.
  • Nothing in these Terms shall exclude or limit liability for death or personal injury caused by KGL’s negligence, or any other liability which cannot be excluded or limited under applicable law.

8. Warranties and Disclaimers

  • KGL provides its services using reasonable skill and care but gives no absolute guarantee. Reports are based on current gemological knowledge and the item’s state at time of testing.
  • The Site and its content are provided “as is” and “as available” without warranty of any kind, whether express or implied (including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement).
  • KGL does not warrant that the Site will be error-free, uninterrupted or secure, or that any defects will be corrected.

9. Privacy & Data Protection

  • KGL collects, uses and stores personal data in accordance with its Privacy Policy (link provided on the Site).
  • By submitting items and associated information, you consent to the collection and processing of your data for the purpose of providing services, issuing Reports, and internal record-keeping.
  • KGL may publish anonymised aggregated data or images for educational or marketing purposes unless you expressly request otherwise in writing.

10. Shipping, Risk of Loss & Items Returned

  • If you ship items for testing, risk of loss or damage remains yours from the time the item is handed to the carrier until it is delivered back to you (or picked up) unless otherwise agreed.
  • KGL may charge packing, insurance, courier or incidental costs; you must reimburse these as applicable.
  • If you disclaim delivery or fail to collect your item within a reasonable period after notification, KGL may charge storage costs and/or dispose of the item according to policy and local law.

11. Report Use & Restrictions

  • Reports issued by KGL are for informational/assessment purposes only and do not constitute a guarantee of future performance, value, durability, or absence of treatments which may become evident later.
  • The Client may use the Report solely for the item assessed and its intended context (e.g., marketing, insurance, trade). Use of the Report for other items or contexts is prohibited.
  • Alteration, forging or misuse of the Report is strictly prohibited. Any such activity may lead to revocation of the Report, additional fees, legal action and nullification of warranties.

12. Termination & Suspension

  • KGL may suspend or terminate services to you, or access to the Site, at any time for breach of these Terms or for any other reason, without prior notice and without liability.
  • Upon termination, you must cease using the Site, destroy any downloaded content, and cease representing any Report or certification as active.

13. Changes to Terms & Services

  • KGL reserves the right to modify these Terms, its Service Policy, fees, or Site content at any time. Changes will be posted on the Site and the date above will update accordingly. Your continued use of the Site or services constitutes acceptance of the modified Terms.
  • It is your responsibility to review these Terms periodically.

14. Governing Law & Dispute Resolution

  • These Terms shall be governed by the laws of India and the competent courts in Bangalore (Bengaluru), Karnataka shall have exclusive jurisdiction.
  • Any dispute arising out of or related to these Terms, services or Reports shall first be referred to mediation/conciliation. If unresolved, it may be submitted to arbitration under the Arbitration and Conciliation Act, 1996 (or any amendment thereof), with the seat of arbitration in Bengaluru, India, in English language. The arbitral award shall be final and binding on both parties.

15. Severability & Waiver

  • If any provision of these Terms is held invalid or unenforceable under applicable law, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
  • The failure by KGL to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
